The Federal High Court in Abuja has upheld FCCPC's statutory authority to investigate consumer complaints about airline ticket pricing, dismissing Air Peace Limited's legal challenge in a June 29, 2026 judgment. Justice B.F.M. Nyako ruled that the Commission's investigative powers under Sections 17, 32, and 33 of the FCCPA, 2018 are separate from its price regulation functions. The Commission lawfully requested information from Air Peace following widespread December 2024 complaints about sharp domestic airfare increases. Air Peace had argued FCCPC could only investigate airfare pricing after presidential activation of price regulation provisions, but the court found this interpretation would undermine the Commission's statutory responsibilities. The judgment clarifies FCCPC neither directed fare reductions nor imposed pricing formulas—it simply exercises fact-finding authority when reasonable grounds exist that consumers or competition may be adversely affected. This aligns with an April 2026 ruling by Justice James Omotosho dismissing a similar Air Peace suit. For frequent air travelers, this means FCCPC can investigate sudden fare hikes you report as potentially exploitative, though investigations don't guarantee fare reductions. Complaints about unfair pricing can be filed through FCCPC channels while the agency maintains its investigatory role.
