SPI-LAW sues FG over Benin–Asaba Expressway decay, wants concession cancelled
The Society of Public Interest Lawyers in Nigeria (SPI-LAW) filed a public interest suit at the Federal High Court, Abuja on September 11, 2026 against the Benin–Asaba Expressway Concession Company Limited, the Attorney-General of the Federation, and the Honourable Minister of Works. The suit, No. FHC/ABJ/CS/2171/2026, seeks to cancel the concession agreement, order the Federal Government to assume control of the highway, and mandate urgent rehabilitation, reconstruction, and traffic safety measures on the deteriorating Benin–Asaba Expressway. SPI-LAW also requests interim orders to protect motorists from ongoing dangers posed by excavated and damaged sections.
The Benin–Asaba Expressway is a critical economic corridor linking Benin City in Edo State to Asaba in Delta State, used daily by motorists, traders, farmers, transport operators, and emergency services. SPI-LAW argues its severe decay exposes road users to avoidable risks of accidents, injury, loss of life, economic hardship, and security threats, constituting a breach of the government’s constitutional duty under Section 14(2)(b) and Section 13 of the 1999 Constitution to protect lives and welfare.
If the court grants the reliefs, the concession could be terminated, triggering federal takeover and immediate repair works.
